Terms of Service

Last updated: October 2026 · Governing law: Victoria, Australia · Prices: AUD (GST inclusive where applicable)

Quies Pro+ is now called the Pro plan. Nothing about your rights or pricing has changed.

1. Acceptance of Terms & Eligibility (Australia only, 18+ only)

By creating an account or using Quies, you agree to these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the app.

Quies is strictly for adults 18 years of age or older.

  • By signing up you confirm you are at least 18 years old. We collect your date of birth at registration to verify this.
  • Quies is not designed, tested, or appropriate for anyone under 18. Intermittent fasting, calorie tracking, and weight monitoring carry documented eating-disorder and developmental risks for minors.
  • If we discover an account belongs to a person under 18, we will suspend the account, delete all associated data within 30 days, and refund any unused subscription in line with the Australian Consumer Law.
  • Parents, guardians, or carers must not create accounts on behalf of a minor. Any data submitted in those circumstances will be deleted on identification.
  • This minimum-age rule applies to all jurisdictions, including those where a younger digital-consent age would otherwise apply.
  • Giving a false date of birth is a breach of these Terms. Your age declaration is a statement you make to us. We keep a minimal record that the declaration was made and when, so that if an account turns out to belong to someone under 18 we can show that the age gate operated and that the declaration was false. We do not use that record for marketing, profiling or any other purpose. If a false declaration is discovered, we will close the account and delete the data as set out above, and we will refund the unused portion of any paid period on a pro-rata basis.

Quies is offered only to residents of Australia.

  • The service is marketed, sold and supplied exclusively to persons ordinarily resident in Australia, in Australian Dollars, and is not offered, targeted or made available to persons in any other country.
  • We check the country associated with your connection at registration. Registrations that do not resolve to Australia are declined.
  • If you move outside Australia, you may continue to read and export your entries, but we do not represent that the service is suitable, lawful or supported in your new location, and we may decline to renew your subscription.
  • Nothing in this clause limits your rights under the Australian Consumer Law.

2. Description of Service — Record-Keeping Tool, Not a Medical Device

Quies is a personal record-keeping and reflection tool. It allows you to track your own intermittent fasting sessions, food and water intake, sleep, mood, habits, weight, and journal entries, and to view that information back to yourself in charts, summaries and reflective prompts.

Quies is NOT:

  • A medical device under the Therapeutic Goods Act 1989 (Cth).
  • A diagnostic, treatment, prevention, monitoring, prognostic or screening tool for any disease, injury or condition.
  • A substitute for advice from a qualified medical practitioner, dietitian, nutritionist, psychologist, personal trainer or other registered health practitioner.
  • A clinical decision-support tool.
  • A weight-loss programme that promises specific outcomes.

Quies is intended to fall within software excluded from regulation as a medical device under the Therapeutic Goods (Medical Devices) Regulations 2002 and the Therapeutic Goods (Excluded Goods) Determination 2018, on the basis that it provides only general health and wellbeing information for maintaining or encouraging healthy lifestyles, and does not provide specific clinical recommendations to individual users.

3. Health & Medical Disclaimer

Quies is for general wellness and informational purposes only. The records, summaries and reflections shown in the app — including AI-generated content — are general information only and are not a substitute for professional medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before:

  • Starting, changing, or stopping any fasting, diet, or exercise program.
  • Making decisions about your health based on information from this app.
  • Using this app if you have diabetes, an eating disorder, a cardiovascular condition, are pregnant or breastfeeding, or have any other medical condition affected by dietary changes.

Quies acknowledges the vital role of qualified professionals. The app does not deliver professional consultations, does not employ or engage practitioners to advise you, and cannot replace a one-on-one relationship with a qualified practitioner. We make no representation that any health practitioner has endorsed, approved or reviewed the app or its content.

Decisions about your health remain yours — please involve a qualified health professional.

4. Artificial Intelligence Disclaimer

Quies uses AI models (Google Gemini via the Lovable AI Gateway) to generate reflective text from what you log — Lux chat, meal ideas, weekly reflections and daily quotes.

  • AI is not a healthcare provider. AI output reflects your own records back to you. It is not medical, nutritional or fitness advice.
  • AI can make mistakes. Output may occasionally be inaccurate, incomplete, or unsuitable for your circumstances.
  • You make the choices. AI text can be wrong — always use your own judgement and consult qualified professionals before acting on them.
  • No training on your data. Health data sent to AI models is not used to train those models.

By using AI features you acknowledge and accept these limitations.

5. User Accounts

You are responsible for maintaining the confidentiality of your credentials. You must provide accurate information and be an individual (not a corporation). We may suspend or terminate accounts that breach these Terms. In plain English: creating an account, joining the waitlist and sending the Contact form need a successful bot check. The waitlist allows five submissions per IP address per hour and Contact allows three. A repeat waitlist submission does not send another confirmation. Sign-in still blocks a failed or unfinished check, but lets you try your password if the check cannot load or its service is unavailable. Sign-in limits still apply. Nothing in this policy excludes your rights under the Australian Consumer Law.

6. Subscription, Billing & GST

Quies offers a free tier and annual paid plans (Quies Pro and Founding Member). All prices are displayed and charged in Australian Dollars (AUD) via Stripe.

GST: Where applicable under Australian tax law, prices include 10% Goods and Services Tax (GST). Tax invoices are issued automatically by Stripe and are available in your account.

Free trial: Annual subscriptions include a 7-day free trial. You can cancel any time before the trial ends and pay nothing.

Cancellation: You may cancel any time via your account settings or by emailing support@quies.dev. Cancellation takes effect at the end of the current billing period; you keep access until then.

In plain English — gifted access: complimentary access is separate from paid billing. A lifetime Founder gift has no subscription fees, no card requirement and no expiry date. The same eligibility, consent and fair-use rules apply. The gift does not start a paid subscription. Descriptions of gifts must be accurate under Australian Consumer Law ss 18 and 29; nothing in these Terms excludes any applicable consumer guarantees.

For a gift with an end date, we attempt one email notice during its final seven days. The notice does not start a paid plan or authorise a charge. Open-ended gifts have no ending notice.

Refund eligibility is governed by our Refund Policy and the Australian Consumer Law.

6A. Fair Use of AI Features

AI features (chat, meal ideas, reflections, daily quotes) come with generous daily limits under this fair-use policy, designed to keep the service sustainable and prevent automated abuse.

  • Personal, human use only. AI features are for your own personal reflection. You must not use them via scripts, bots, scrapers, automated tooling, or any process that simulates a human user.
  • Reasonable per-day volume. Sustained usage that materially exceeds typical human use (for example, hundreds of AI chat messages in a single day, repeated identical prompts, or generating output to redistribute) falls outside fair use.
  • No resale or redistribution. You must not on-sell, repackage, embed, syndicate, or otherwise redistribute AI output generated through Quies.
  • No model extraction. You must not use AI features to train, fine-tune, evaluate, benchmark, or reverse-engineer any other AI model.
  • Reasonable measures. We may apply per-day caps, per-minute burst limits and output-length caps; when you reach a limit, the app tells you and shows when it resets. These caps are sized so that ordinary, human, personal use is never affected.

If we identify usage that is inconsistent with fair use, we may, at our sole discretion and in proportion to the conduct: apply a temporary throttle to your AI quota; pause your access to AI features; permanently disable AI features on your account; or, in serious or repeated cases, suspend or terminate your account and refund any unused portion of your subscription in line with the Australian Consumer Law.

Any non-AI features of Quies (logging, charts, journal, exports, etc.) are not affected by this clause and remain unlimited in the ordinary sense.

7. Australian Consumer Law (ACL) Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Specifically, Quies Pro services are guaranteed to be:

  • Provided with due care and skill (s 60 ACL);
  • Reasonably fit for the purpose you made known to us (s 61);
  • Provided within a reasonable time (s 62).

If a service has a major failure, you are entitled to cancel and receive a refund, or to keep the service and seek compensation for the drop in value. For non-major failures, you are entitled to have the problem fixed within a reasonable time. See our Refund Policy for the practical process.

8. Privacy & Data Location

Your privacy is governed by our Privacy Policy, incorporated into these Terms by reference. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Important — your data is stored outside Australia:

Your personal and health information is stored in Tokyo, Japan (AWS region ap-northeast-1) by our infrastructure provider Supabase. Before disclosing personal information overseas we take reasonable steps to ensure each recipient handles it consistently with the Australian Privacy Principles (APP 8.1), including contractual data-processing terms. Under s 16C of the Privacy Act, we remain accountable for the handling of your data by these overseas recipients. Full details are in Section 5 of the Privacy Policy.

9. Health Data

You retain ownership of all health data you enter (fasting times, weight, glucose, journal entries, etc.). We use it only to provide the service and we do not sell it. We may use anonymised, aggregated data to improve the product. You can download a copy of your data, or delete it, at any time from your Profile.

9B. Connected Devices (Oura Ring)

Quies can connect to an Oura Ring if you choose. You need your own Oura account and ring; Oura charges for those separately and we have no control over its pricing, its app, or whether its service is available.

The sleep, readiness, activity and heart-rate figures we show you are Oura's own estimates produced by its sensors and software. They are not medical measurements, we do not verify or correct them, and Quies only records them and shows them back to you. Do not rely on them to make decisions about your health — see a qualified health practitioner.

Connecting a ring costs nothing extra on your Quies plan. You can disconnect at any time from Health Sync, which withdraws our access at Oura and removes the ring days from your diary.

Nothing in this clause limits the consumer guarantees you have under the Australian Consumer Law, which cannot be excluded.

9A. Closing Your Account

You can close your account yourself at any time from Profile → Danger Zone → Delete Account. You will be asked to type DELETE so it cannot happen by accident.

When you confirm, everything you tracked is erased right away and your sign-in is removed, so the account no longer exists. If you have a paid subscription, we cancel it at the same time so your card is never charged again.

This cannot be undone. We cannot bring an account back once it has been deleted, so download a copy of your data first if you want to keep it (Profile → Export my data).

Deleting your account is not the same as asking for a refund, and it does not automatically refund the current billing period. If you only want to stop future payments but keep your history, cancel your subscription instead and keep the account open. See our Cancellations & Refunds page.

We may also close an account that breaches these Terms. Where we do, we will tell you at the email address on the account unless the law prevents us, and we will refund any amount you have paid for a period of service you will not receive.

Legal note: nothing in this clause excludes, restricts or modifies the consumer guarantees in the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including the guarantees as to due care and skill (s 60), fitness for a disclosed purpose (s 61) and services supplied within a reasonable time (s 62), or your remedies under ss 267 and 269. Cancellation and closure are provided as a self-service, no-barrier process consistent with ACCC guidance on subscription traps and automatic renewals, and with the unfair contract terms regime in ss 23–25 of the Australian Consumer Law. Personal information is handled on closure in accordance with APP 11 of the Privacy Act 1988 (Cth) as described in Section 12 of the Privacy Policy.

10. Intellectual Property

All content, design, code, and branding of Quies is owned by [Your Company Name] ABN [Your ABN]. You may not copy, reproduce, modify, or distribute any part of Quies without written permission.

11. Prohibited Conduct

You must not: use Quies for any unlawful purpose; attempt to gain unauthorised access to any system; upload malicious code; impersonate another person; reverse-engineer the app; or use Quies to harm yourself or others.

12. Limitation of Liability

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees or your remedies for a failure to comply with them.

Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from decisions you make based on your own records or on AI-generated reflections, except where the loss results from our negligence or from a failure to comply with a consumer guarantee.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email or in-app notification at least 14 days before material changes take effect. If you do not accept a material change, you may cancel before it takes effect and we will refund the unused portion of any prepaid period on a pro-rata basis.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of the courts of Victoria. Nothing in this clause prevents you from bringing a claim in your local jurisdiction where required by Australian Consumer Law.
